These Terms of Use and our Privacy Policy, form a legally binding contract (Agreement as defined below) between you and us.

2. Definition of Terms

• "Agreement" means the agreement between you and Tecat Ltd that is formed when you accept these Terms of Use, together with the Privacy Policy and any other agreed terms and conditions;
• "Services" means the services available on Dating88.com;
• "A User" means a person registered with Dating88.com;
• "Standard Member" means a user with access only to the free Services;
• "Gold Member" means a user with access to all Services;
• "User Content" means any and all information published by Users on the site (profiles), or sent out by Users using the channels provided on the site

3. Updates and Amendments

Tecat Ltd may update and amend these Terms of Use or Privacy Policy at any time and we will make the updated versions available through the Site. You understand and agree that you will be deemed to have accepted the updated Terms of Use or Privacy Policy if you use the Services after the updated versions are made available to you. If at any point in time, you do not agree to any part of the Terms of Use or Privacy Policy you should delete your account and stop using the Services immediately.

4. Eligibility to Use the Site and the Services

You can only use our Services under the following conditions:

• You are over 18 and can enter into a legally binding contract with us
• You provide correct, accurate and true information that is not misleading. In particular, you must be truthful and honest when completing your profile and in your communications with other users and us.
• You acknowledge and agree that the Services’ purpose is to enable single individuals to connect on a personal, non-commercial, and non-financial basis, with the primary goal of forming committed relationships as a couple. You must abide by and be respectful of the Services’ purpose at all times.
• You have never been convicted of an unlawful act involving fraud, a sexual offense, violence (including domestic violence), harassment, terrorism or a hate crime.

We reserve the right to decline, suspend or terminate your access or membership at any time if you do not meet any of these conditions.

We also reserve the right to decline, suspend or terminate your access or membership at any time if we consider your behavior harmful to our website, for example, providing a substandard quality Profile

5. User Obligations

You acknowledge that your use of the Services is solely at your own risk and you agree that you will not:

• impersonate any person or misrepresent your age or marital status or place information in your profile;
• post any contact information including email addresses, phone numbers, postal addresses, instant messenger IDs in your profile;
• use the Services for any unauthorized commercial purposes;
• attempt to gain unauthorized access to any part of the Services or to the equipment used to provide the Services;
• engage in any form of harassment or offensive behavior, including the distribution of any sexually or racially offensive, abusive, threatening, vulgar, obscene, defamatory or any objectionable material of any kind when interacting with other users of the Site and/or our customer support team;
• post any links to third-party websites which are illegal;
• use the Services to engage in group sexual activity, or to solicit prostitution or any other activities that may be illegal in your country of residence;
• breach any applicable law, regulation or code of conduct;

You must notify us in writing immediately if you become aware of any illegal materials among user profiles or communications, we may report details to the appropriate Law Enforcement Agency.

6. Content Monitoring and Control

We do not verify the accuracy or truth of any information published by Users and we are not the publisher of such information. You should therefore conduct your own independent investigations to verify the accuracy of information published or sent by other Users and be careful when dealing with other Users

We reserve the right to monitor all profiles, and messages, to ensure that they conform to the requirements of these Terms of Use, in line with our efforts to provide the safest online environment for our customers;

While we do not and cannot review all messages or other material posted or sent by Users, we request all Users to notify us of any inappropriate User Content by emailing us (cs@dating88.com). Please provide us with the offending member's ID which is shown on all Profile pages so we can locate the content. While we are not responsible for any content of these messages or profiles, we reserve the right to edit or remove them that we deem to breach these Terms of Use or to be otherwise unacceptable.

We reserve the right to refuse the publication of subquality profiles, and the right to to suspend or delete memberships at our sole discretion

7. Intellectual Property

The Site contains content such as marks, logos, graphics, text, images and photographs that are the intellectual property of our partners, other Users and us. Your right of use is strictly limited to accessing, downloading, printing and reproducing such content for your own personal and non-commercial use within the scope of these Terms.

You may not copy or otherwise use any Content of other Users except insofar as strictly necessary for your personal and non-commercial use. You may not publish or post any material on the Site belonging to a third party unless you have permission to do so. You should notify us if you believe material belonging to a third party has been posted or sent by another User.

8. Membership Types and Upgrades

There are two types of memberships on Dating88.com:

• Standard membership: This membership is FREE. Anybody who registered with Dating88.com and completed the Profile will automatically have this membership. This membership allows the use of most features on the website, however, a Standard member can not initiate contact with another member but can respond if another member initiates the contact.
• Gold membership: This membership allows using all features, including smiling to and massaging any member to initiate contact.

Standard members can make a one-time payment to upgrade the membership to Gold for a fixed length of time, the membership returns to the Standard type automatically when the upgrade expires.

The supply of the upgraded membership service will be deemed to have been fully completed upon your first contact initiation by smiling or messaging.

9. Terminate Your Account

You may at any time terminate your account using facilities provided on the Site.

We may suspend or terminate your Account at any time if in our reasonable opinion you have committed a serious breach of this Agreement or your continued use of the Site is or might be damaging to our business or to other Users.

10. Refund Policy

The supply of the Gold membership service will be deemed to have been fully completed upon your first contact initiation by smiling or messaging.

We will issue a full refund if the paying member requests a refund prior to initiating contact with any other member by smiling or messaging in the related paid period.

We will also issue a full refund if we suspend or terminate a paying member and that member has not initiated contact with any other member by smiling or messaging in the related paid period.

We will not issue any partial refunds due to the nature of our Services.

11. Safety and Security

Our experienced vetting team checks new User profiles (and updates to them) for inappropriate content and tries to identify and remove possible scammers from the Site. However, we are not in a position to verify the identity of Users or the accuracy of User Content, nor can we guarantee that our vetting processes will spot all inappropriate User Content.

Your use of these Services is entirely at your own risk. You should exercise caution in evaluating what you see when involved in internet communication with people who are unknown to you (such as when you are using message services) and be aware that people may not necessarily be who they say they are and that people may provide information or behave in a way that is unreliable, misleading or illegal.

By using these Services you accept that any member profiles, messages and communication may not be genuine and you agree to take reasonable precautions in all interactions with other members or users of the Site or Services, particularly if you decide to meet offline or in person. You are solely responsible for your interactions with other members or users of the Site or the Services. You should not provide your personal or financial information (for example, your credit card, national insurance number or bank account information) to other members or users of our Site.

12. Performance of the Site and the Services

The Services are provided to you on an "as is" basis by Tecat Ltd. Although we will use our best efforts to rectify any faults occurring at the Site, we do not guarantee that our Services will be error-free or uninterrupted or will achieve particular results.

We reserve the right to suspend the Services at any time without notice for repair, maintenance, improvement or other technical reasons, but we will normally try to do so only between 10 p.m. and 6 a.m. to minimize disruption

13. Anti-Slavery and Human Trafficking Statement

14. Complaint Policy

• We will log and monitor all serious complaints and the results of such complaints and this information will be brought, regularly, to the attention of management so that we learn from what we do and how we do it.

15. Limitation of Liability

This section applies to our directors, officers, employees, subcontractors and agents as well as to us.

We do not accept any responsibility or liability for any indirect losses (such as loss of profits, contracts or business) even if we have been advised of.

We do not accept any responsibility or liability for any loss or damage you suffer if you cause or contribute to such loss or damage by your acts or omissions;

We do not accept any responsibility or liability for failure to perform or delay in performing any obligation under this Agreement if the failure or delay is caused by any circumstances beyond our reasonable control;

We do not accept any responsibility or liability for the conduct of any member or user of the Site, including without limitation any conduct which causes physical injury to any person

16. Governing Law

You agree that this Agreement (defined above) is governed by the laws of England and Wales and submit to the exclusive jurisdiction of the courts of England and Wales.
